Process of settlement of protests regarding relevant issues during bidding course
During the bidding course, as of prior to the date of notification of bidding results, a Bidder has right to make protest(s) against relevant issues in the bidding process as follows:
Step 1: A Bidder may send a written protest to the Bid Solicitor. Within a maximum of 5 working days from the date of receipt of the Bidder’s written protest, the Bid Solicitor shall be responsible for settlement of the Bidder’s protest.
In case the Bid Solicitor does not seetle the protest or the Bidder disagrees with the Bid Solicitor’s resolution, the Bidder is entitled to send the protest to the investor for consideration and resolution as specified in step 2.
Step 2: Investor is responsible for settlement of Bidder’s protest within a maximum of 7 working days from the date of receipt of the written protest of the Bidder.
In case the investor does not settle the protest or the Bidder disagree with the investor’s resolution, the Bidder shall have the right to lodge the protest with the competent person for consideration and resolution as specified in step 3.
Step 3: Within a maximum of 10 working days from the date of receipt of the written protest of the Bidder, the competent person is responsible for settlement of the Bidder’s protest.
In case the competent person does not settle the protest or the Bidder disagrees with the resolution of competent person, the Bidder has the right to initiate court proceedings.
